How overtime works in Canada
Overtime is set by provincial and territorial employment standards, or by the Canada Labour Code for federally regulated jobs. In most places overtime is paid at one and a half times your regular wage, usually called time and a half.
When overtime starts depends on where you work. In Ontario it starts after 44 hours in a work week. Many other provinces use 40 hours a week, and some also count hours over 8 in a day. Check your province's employment standards for the exact rules, exemptions and averaging agreements.
Examples
- Ontario: $25 an hour for 44 hours plus 6 hours at time and a half ($37.50 an hour) is $1,100 + $225 = $1,325 for the week. Every week, that is $68,900 a year.
- A 40-hour province: $25 an hour for 40 hours plus 6 overtime hours is $1,000 + $225 = $1,225 for the week.
Frequently asked questions
Can I take time off instead of overtime pay?
Many provinces allow banked time or time off in lieu, usually at one and a half hours off for each overtime hour, if you and your employer agree in writing. The rules differ by province.
Do managers get overtime?
Managers, supervisors and some professions are often exempt from overtime rules. Whether you are exempt depends on your actual duties and your province's rules, not just your job title.
